Who we are and where your data is stored

Smartlux

Smartlux SARL is a company registered in Luxembourg (click for contact info). This privacy policy applies to all websites we maintain (unless they have their own privacy policy), and all software we publish. It also applies to all data you send us by e-mail or by other means.

Location

Unless otherwise specified below, data we collect is stored on our premises in Luxembourg or with one of our web hosts (located within the EU).

Information we collect automatically

When you visit our website

No personal data is collected (your IP address is anonymized by our web host before it is stored in the access or error log on our server).

When you use our software

We do not track your use of our software.

Our software may contact our server to check for updates. No personal data is transmitted to us during the update check (the software reads a file on our server containing the current version number).

When you use a licensed (paid) version of our software , it may contact our server to confirm the validity of your license and to ensure that the maximum number of concurrent users has not been exceeded. During this procedure, your license key will not be associated with personal data we may have on file.

Information you provide to us

We collect information that you provide to us, e.g. by contacting us, leaving a comment or filling out a form on our website.  In addition to the data that you can see, we may collect additional data as explained below.

Comments

We collect your IP address and browser user agent string to help spam detection.

Order forms

When purchasing a product directly on our website, we collect your IP address for fraud prevention purposes.

Data we receive from third parties

When purchasing a software license

If you purchase a license through our reseller FastSpring, you will have to submit some personal data which Fastspring will make available to us. FastSpring’s privacy statement can be found here.

Who we share your data with

We do not sell your private data. We do not use it for marketing purposes without your explicit consent.

Spam detection

Visitor comments may be checked through the Akismet automated spam detection service provided by Automattic Inc. Their privacy policy can be found here.

Payment providers

When you use a payment service embedded on our website, the data you enter will be sent to the payment provider.

Fulfillment of orders

When ordering physical items, we may provide your data to the transport company or the supplier in charge of delivery. This data may include your email and phone number in order to facilitate the delivery.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

How long we retain your data

Generally, we discard information about you when we no longer need it for the purposes for which we collect and use it and when we are not legally required to continue to keep it.

As a customer, your data will be deleted after completion of the contract and after expiry of any legal retention periods. If you are not our customer, your data will be deleted 3 years after the last contact. This applies unless you have expressly consented to further use of your data or unless we reserve the right to use data beyond this period in a ways permitted by law and about which we inform you in this declaration.

For example, if you leave a public comment on our website, the comment and its metadata are retained as long as the article you commented on is still available.

Legal basis for processing your data

We will only collect personal data as described above when one or more of the following applies:

  • you have given us your consent, for example, when you sign up for a newsletter;
  • processing is necessary to fulfill our contractual obligations to you or to take steps at your request prior to entering into a contract, for example, when place an order with us;
  • processing is necessary for compliance with a legal obligation; for example, due to accounting and taxation laws;
  • processing is in our legitimate interest and these interests are not overridden by your data protection interests or fundamental rights and freedoms. Our legitimate interests include: ensuring the security of our services, protection from piracy and unlawful use of our software, improvement of our services.

What rights you have over your data

If you are located in certain countries, including those that fall under the scope of the European General Data Protection Regulation (the “GDPR”), data protection laws give you rights with respect to your personal data, subject to any exemptions provided by the law, including the rights to:

  • Request access to your personal data;
  • Request correction or deletion of your personal data;
  • Object to our use and processing of your personal data;
  • Request that we limit our use and processing of your personal data; and
  • Request portability of your personal data.

EU individuals also have the right to make a complaint to a government supervisory authority.

Third party services and embedded content from other websites

This site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

Ads

Amazon affiliate program

Our websites may use Amazon’s affiliate program, which may set cookies and use tracking pixels. You can find Amazon’s privacy notice here.

Google Adsense

Our websites may use Google AdSense do show ads. Various cookies may be sent to your browser.  You have the option to opt out of Google’s use of cookies by visiting the Google advertising opt-out page. Alternatively you can opt-out of cookies by visiting the Digital Advertising Alliance opt out page.

Analytics

We use Clicky, an analytics service by Roxr Software Ltd. which uses cookies and collects anonymized IP addresses to compile usage statistics and track user behavior on our website (but not across different websites). You can opt out by using one of the methods described in Clicky’s privacy policy.

Discussion forums

Our websites may use Disqus to provide a discussion forum (e.g. for customer support). Disqus’ privacy policy can be found here. When used, discussion forums provided by Disqus are clearly marked and contain a link to their privacy policy.

Fonts

Our websites may use Google Fonts to minimize loading times. Further information on visitor privacy and the use of Google Fonts can be found here.

Maps

Our websites may use use Google Maps. Google’s privacy policy can be found here.

Newsletters

We use MailChimp to send newsletters. You must explicitly register to receive a newsletter, we will never sign you up automatically. You can find MailChimp’s privacy policy here.

Site search

Our websites may use full text search provided by Microsoft. When using this search function, the search term is transferred to Microsoft. Microsoft’s privacy policy can be found here.

Videos

This website may use embedded videos from YouTube. We use the  privacy-enhanced mode when embedding videos, which means that YouTube won’t store information about you unless you play the video. Google’s privacy policy can be found here.
